Welcome to Lotus365 Legends! These Terms and Conditions outline the rules and regulations for the use of our mobile application, Lotus365 Legends (the "App"), and the services provided therein (collectively, the "Services"). By accessing or using Lotus365 Legends, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App or the Services.

1. Acceptance of Terms

By accessing or using Lotus365 Legends, you confirm that you have read, understood, and agree to be bound by these Terms and any additional guidelines, policies, or rules applicable to our Services. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. It is your responsibility to review these Terms regularly for any updates.

2. Eligibility

You must be at least 18 years of age to use Lotus365 Legends. By using the App, you represent and warrant that you are at least 18 years old. If you are under the age of 18, you must use Lotus365 Legends with the consent of your parent or guardian.

3. Account Registration

To access certain features of Lotus365 Legends, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information to keep it accurate, current, and complete.
• Safeguard your account information, including your password, and take full responsibility for all activities that occur under your account.

4. User Conduct

By using Lotus365 Legends, you agree not to:

• Use the Services for any unlawful purpose or in a way that violates these Terms.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App or Services.
• Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
• Transmit any advertising or promotional materials, including "junk mail," "chain letters," or "spam."
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
• Upload, post, or transmit any content that is unlawful, defamatory, obscene, abusive, or otherwise objectionable.
• Engage in any activity that could harm minors.
• Collect or store personal data about other users without their express consent.

5. User-Generated Content

You may have the opportunity to submit, post, or otherwise make available content through Lotus365 Legends (the "User Content"). By submitting User Content, you grant Lotus365 Legends a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such User Content in any media.

You are solely responsible for your User Content and the consequences of submitting it. You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not violate any third-party rights.

6. Intellectual Property Rights

All content, features, and functionality (including but not limited to text, graphics, logos, icons, software, and data compilations) in the App are owned by or licensed to Lotus365 Legends and are protected by copyright, trademark, patent, and other intellectual property laws. The unauthorized use of any content from Lotus365 Legends is strictly prohibited.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. This license does not permit you to sell, modify, reproduce, distribute, publicly display, or create derivative works of the App or its content.

7. Third-Party Links and Services

Lotus365 Legends may contain links to third-party websites or services that are not owned or controlled by Lotus365 Legends. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any such third-party websites or services. You acknowledge and agree that Lotus365 Legends shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of any such content, goods, or services available on or through any such websites or services.

8. In-App Purchases

Lotus365 Legends may offer in-app purchases that require payment. By making a purchase, you agree to pay all applicable fees and taxes. All sales are final, and no refunds will be provided unless otherwise stated. You are responsible for any charges incurred through your use of the App, including any in-app purchases.

If you choose to make in-app purchases, you must provide valid payment information and comply with your payment provider’s terms and conditions. We reserve the right to change our pricing for the Services at any time.

9. Termination

We may terminate or suspend your access to Lotus365 Legends, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that, by their nature, should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

You understand and agree that the App and Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by applicable law, Lotus365 Legends disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Lotus365 Legends shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App or Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, or the like that may be transmitted to or through the App; and (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of the App or any content posted, emailed, transmitted, or otherwise made available via the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lotus365 Legends, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, service providers, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App or Services, including, but not limited to, your User Content, any use of the App's content, services, or products other than as expressly authorized in these Terms, or your use of any information obtained from the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles. You agree that any disputes arising out of or relating to these Terms or your use of the App will be resolved in the courts.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms in the App or sending you an email. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

16. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and Lotus365 Legends regarding your use of the App and supersede any prior agreements between you and Lotus365 Legends.
• Waiver: No waiver of any breach of any provision of these Terms shall constitute a waiver of any subsequent breach or a waiver of the provision itself.

By using Lotus365 Legends, you acknowledge that you have read these Terms and agree to be bound by them.
